California Probate Code section 6110 generally requires a written will, the testator’s signature, and signatures from at least two witnesses who were present at the same time and understood the instrument was the testator’s will. California Probate Code section 6111 separately recognizes holographic wills, where the signature and material provisions are in the testator’s own handwriting, without requiring witnesses. Whether a holographic form is appropriate for a particular amendment depends on the circumstances, and an improperly executed document can be challenged during probate.
The governing execution rules apply statewide. What differs locally is how those documents are administered. Kern County Superior Court’s probate division handles wills, estates, and trusts for Bakersfield residents.
